Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you and PollAsk ("PollAsk," "we," "us," or "our") governing all access to and use of the PollAsk social polling platform, website, and associated services (collectively, the "Service"). By accessing or using the Service in any capacity, you confirm that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree, you must not access or use the Service.
1. Acceptance
Your access to the Service is conditional upon your full and unconditional acceptance of these Terms and our Privacy Policy. Creating an account, casting a vote, publishing a poll, or simply browsing the Service constitutes acceptance. These Terms supersede any prior agreements or understandings between you and PollAsk. PollAsk reserves the right to update these Terms at any time; continued use following an update constitutes acceptance of the revised Terms.
2. Eligibility
Access to the Service is strictly limited to individuals who are 18 years of age or older and have the full legal capacity to enter into binding contracts. By using the Service, you represent and warrant that you meet this requirement. Any account found to belong to a user under the age of 18 will be permanently and irrevocably deleted without prior notice, regardless of whether the account was created using false information. PollAsk assumes no liability for any content created or activity generated by underage users prior to detection and removal.
3. Account Responsibilities
You are solely and fully responsible for your account. By registering, you agree to the following obligations:
- You must provide accurate, truthful, and complete information at registration and keep it current at all times. Providing false information — including a false date of birth — is a material violation of these Terms and grounds for immediate account termination.
- You are responsible for maintaining the confidentiality of your credentials and for all activity conducted under your account, whether or not authorized by you.
- You must notify us immediately at legal@pollask.com upon becoming aware of any unauthorized access to your account or any security breach affecting your credentials.
- You may not create multiple accounts to circumvent a suspension, ban, or any other restriction imposed by PollAsk. Detected duplicate accounts will be terminated without notice.
4. Prohibited Conduct
The following conduct is strictly prohibited and will result in immediate, permanent account termination without warning, appeal, or refund:
- Publishing, sharing, or promoting content that is illegal, threatening, abusive, harassing, defamatory, obscene, pornographic, hateful, inciteful, or discriminatory on the basis of race, ethnicity, gender, religion, disability, sexual orientation, or any other protected characteristic.
- Impersonating any individual, organization, or entity, or misrepresenting your identity or affiliation in any way.
- Deploying automated tools, bots, scrapers, crawlers, or scripts to access, interact with, extract data from, or manipulate the Service in any way without PollAsk's prior written authorization.
- Attempting to probe, scan, test, or exploit vulnerabilities in the Service's infrastructure, or engaging in any form of denial-of-service attack, injection attack, or unauthorized access attempt.
- Harvesting, collecting, or processing personal information of other users without their explicit and informed consent.
- Using the Service to distribute spam, phishing content, pyramid schemes, fraudulent promotions, or any unsolicited commercial communications.
- Attempting to bypass, disable, or undermine any authentication, rate limiting, moderation, or security mechanism of the Service.
5. User Content and License
You retain ownership of content you create on PollAsk. However, by publishing content on the Service, you grant the following:
- A perpetual, irrevocable, worldwide, royalty-free, sublicensable license to PollAsk to use, reproduce, display, distribute, and adapt your content solely for the purpose of operating, maintaining, and improving the Service.
- You warrant that all content you publish is original or that you hold all necessary rights to it, and that it does not infringe upon the intellectual property, privacy, or any other rights of third parties. You assume full legal liability for any content you submit.
- PollAsk reserves the right to remove, hide, or permanently delete any content that violates these Terms, applicable law, or our community standards — at our sole discretion, at any time, without prior notice, and without liability to you.
6. Intellectual Property
All intellectual property comprising the Service — including but not limited to the PollAsk name, logo, brand identity, visual design, source code, algorithms, data structures, and user interface — is the exclusive property of PollAsk and is protected under applicable copyright, trademark, and intellectual property law. You are granted no rights, licenses, or interests in any PollAsk intellectual property by virtue of using the Service. Any unauthorized use, reproduction, or distribution of PollAsk's intellectual property may result in civil and criminal liability.
7. Third-Party Integrations
The Service incorporates third-party technologies over which PollAsk exercises no direct control. These include:
- Google OAuth for secure user authentication and account access.
- Google AdSense for the delivery of contextually relevant advertising.
- Third-party analytics providers used to measure platform performance and inform product improvements.
8. Disclaimer of Warranties
The Service is provided strictly on an "as is" and "as available" basis. PollAsk expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, title, accuracy, or non-infringement. We make no representation that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. You use the Service entirely at your own risk.
9. Limitation of Liability
To the fullest extent permitted by law, PollAsk and its officers, directors, employees, agents, and licensors shall bear no liability for any indirect, incidental, special, consequential, exemplary, or punitive damages — including loss of data, revenue, goodwill, or business opportunity — arising from or related to your use of or inability to use the Service, even if PollAsk has been advised of the possibility of such damages. PollAsk's total cumulative liability to you for any and all claims shall not exceed the greater of (i) the amount you paid to PollAsk in the twelve months preceding the claim, or (ii) one U.S. dollar (USD $1.00).
10. Account Suspension and Termination
PollAsk reserves the absolute and unilateral right to suspend, restrict, or permanently terminate any account — with or without cause, with or without notice — at any time we determine, in our sole discretion, that a user has violated these Terms, engaged in harmful conduct, or poses a risk to the platform or its users. Termination is immediate and final. Banned users are permanently prohibited from creating new accounts or accessing the Service under any other identity. Attempts to circumvent a ban will result in escalation including potential legal action. PollAsk assumes no obligation to preserve or return any content, data, or credits associated with a terminated account.
11. Amendments
PollAsk may revise these Terms at any time without prior notice. Revisions take effect upon publication. It is your responsibility to review these Terms periodically. Continued use of the Service following any revision constitutes your binding acceptance of the updated Terms. If you do not accept a revision, your sole remedy is to immediately cease using the Service and permanently delete your account.
12. Governing Law and Jurisdiction
These Terms are governed exclusively by the laws of the jurisdiction in which PollAsk is incorporated, without regard to any conflict-of-law provisions. You irrevocably submit to the exclusive jurisdiction of the courts of that jurisdiction for the resolution of any dispute arising from or relating to these Terms or the Service. PollAsk additionally reserves the right to seek injunctive or equitable relief in any court of competent jurisdiction.
